45 DAY SATISFACTION GUARANTEE
Tangerine Office Systems strives to provide our customers with the highest level of service possible. We want you to be completely satisfied with your toner purchase. All of our toner and ink products carry a 45 day satisfaction guarantee, or we will replace them free of charge. If for any reason our compatible products appear to be the cause of down time or damage, Tangerine will send out our service technician (in Clark County) within 24 hours at no charge to your facility.
CONSUMABLE PRODUCTS:
Toner & Ink: Full refund or exchange will be given within 45 days of purchase. Products produced by Seller qualify for a full refund or exchange within 45 days of purchase and for exchange only within 180 days of receipt by buyer. No restocking fee will be charged for product returned in exchange for like product within 45 days. Open merchandise will automatically be subject to a 20% restocking fee. For an even exchange or refund the product must be in its original condition, including the box, packaging and all accessories, with no markings. Defective product over 45 days old will not be eligible for return or exchange, however may be covered by the original manufacturer. Merchandise purchased up to 60 days prior may be evaluated for return, but will be subject to a 25% restocking fee.
Office products: (i.e.: pens, folders, labels, etc) Full refund or exchange will be given within 30 days from the date of purchase. Open merchandise will automatically be subject to a 20% restocking fee. For an even exchange or refund the product must be in its original condition, including the box, packaging and all accessories, with no markings. Merchandise purchased over 30 days prior may be evaluated for return, but will be subject to a 25% restocking fee.
Furniture/Special Orders: Furniture is subject to natural wear and tear, so we can only accept it for return within 14 days of the date of receipt. Special Order and customer-assembled furniture is made and/or assembled to your specifications, so it is only returnable if it is defective and unrepairable when you receive it.
Technology: Most small electronics come with a direct manufacturers' warranty. Because of such rapid technological changes, these products can only be exchanged for 14 days in original packaging, without markings and with all accessories to qualify for a full refund, exchange or credit.
Xerox Products: As a Xerox Authorized Dealer any Xerox printer, scanner, fax or multifunction machine are subject to the provisions of the Xerox Warranty. If you have any difficulties our Service Department can be reached at (702) 260-6650 to assist your every need.
PRICE CHANGES: All prices are subject to change without prior advance notice. Buyer shall pay prices as are in effect at time of delivery, subject to 45 Day Satisfaction Guarantee.
DELIVERY: Most goods shall be delivered F.O.B. point of purchase, within the delivery area of seller unless otherwise specified. Risk of loss shall pass to buyer upon delivery of goods.
PAST DUE ACCOUNTS/PAYMENTS: All payments received after THIRTY (30) days from date of invoice shall be subject to an interest rate computed at 1.5% per month on an 18% annual rate. Any checks returned as insufficient funds will automatically be charged an additional $25.00 processing fee and payment then must be made by credit card or cashiers' check within 5 business days. In the event of dispute the parties agree that the Uniform Commercial Code as enacted in Nevada shall govern the Seller for any costs incurred by Seller in collecting amounts overdue under this agreement, including without limitation all attorney fees and court costs.
WARRANTY: Products furnished by suppliers to Seller and distributed by Seller to Buyer are warranted by Seller only to the extent of the original manufacturer's express warranties to Seller. All other goods are warranted to Buyer against failures shown by direct evidence to have been caused solely by specific defects in Seller's materials and workmanship, and that the failure could have been avoided or detected by Seller under generally accepted practices in Seller's industry.
THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, SELLER MAKES NO OTHER WARRANTIES OF ANY KIND EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY WARRANTY OF PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. ALL CLAIMS MUST BE MADE IN ACCORDANCE WITH "CLAIMS PROCEDURE" SET FORTH HEREIN BELOW.
CLAIMS PROCEDURE: Seller will give immediate consideration to all claims submitted in accordance with the following uniform policies and procedures: Seller shall not be liable unless notice in writing together with representative samples of any claimed unsatisfactory goods are received within the warranty/guarantee period.
LIABILITY AND REMEDY: Buyer's exclusive remedy and Seller's sole liability on any claim whether in tort, contract or warranty shall not exceed the cost to Buyer for the disputed goods, or at Seller's option, the shipment of conforming goods and return of disputed goods by Buyer.
ENTIRE AGREEMENT: This agreement constitutes the entire agreement between Buyer and Seller regarding the goods and services identified herein and supersedes all prior written or oral undertakings, and may be neither changed nor waived in any respect, except as hereafter agreed by both parties in writing. Failure to enforce any provision shall not operate as a waiver. In the event of dispute the parties agree that the Uniform Commercial Code as enacted in Nevada shall govern.
